The issue raised in the present petition is for regarding the recovery of over payment of retiral benefits allegedly on the basis of wrongly fixation of pay, without therebeing any misrepresentation/suppression of facts on the part of the petitioner.

The Division Bench on 27.02.2006 passed the same interim order as granted in CWP-17822-2005 titled as Sohan Lal Dhand vs. State of Punjab and Others, reference of which was made in the index of the petition stating therein to be similar and pending, which has since been disposed of on 03.05.2025 along with two other writ petitions with regard to the aspect of recovery alone by relying on the judgment of Hon'ble Supreme Court in Jogeshwar Sahoo and others vs. The District Judge, Cuttack and others, SLP (C) No(s). 5918-2024, decided on 04.04.2025.
