Rajender @ Parveen @ Golu v. State Of Haryana
-1CRM-M-41160 of 2017
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CRM-M-41160 of 2017 Date of Decision: 07.11.2017 Rajender @ Parveen @ Golu ....Petitioner
Versus
State of Haryana ....Respondent CORAM: HON'BLE MR. JUSTICE RAMENDRA JAIN Present: - Mr. Rajesh Khandelwal, Advocate, for the petitioner. Mr. Vikas Chopra, DAG, Haryana.
RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Rajender @ Parveen @ Golu in a case arising from FIR No.0854 dated 27.09.2017 under Sections 307, 34 IPC and 25 of the Arms Act (added later on) registered at Police Station City Hisar.
Learned counsel for the petitioner inter alia contends that the petitioner is not named in the FIR. He has been falsely implicated. The petitioner is in custody since 09.10.2017. No recovery has to be effected from him. The conclusion of trial shall take a long time. No useful purpose would be served by detaining the petitioner in jail. On the other hand, learned State counsel vehemently opposed the prayer for grant of regular bail to the petitioner. Considering over-all facts and circumstances, but without Ravinder Singh 2017.11.07 16:56 I attest to the accuracy and authenticity of this document expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing
-2CRM-M-41160 of 2017 bail bonds and surety bonds, to the satisfaction of Trial Court/Duty Magistrate concerned.
