Petitioners claim that they have attained majority and married against the wishes of their family members. Apprehending threat to their life and liberty, they have filed this petition for protection.
Notice of motion to the Advocate General, Punjab. On asking of the Court, notice has been accepted by Ms.H.K.Athwal, DAG., Punjab, present in the the Court. Copy given.
The petitioners appear to have submitted a representation Annexure P4 dated 30.11.2015, to the Senior Superintendent of Police, Kapurthala.
The facts and circumstances of this case are covered by the judgment in Pardeep Kumar Vs.State of Haryana, 2008 (3) RCR (Crl.) 376.
CRM-M-41149-2015 (O&M) This petition is disposed of with a direction to the Senior Superintendent of Police, Kapurthala, to look into the representation Annexure P4 dated 30.11.2015 and that the petitioners will not be forcibly taken in custody by any of the respondents on the allegation that petitioner No.1 has been kidnapped or abducted by petitioner No.2. In case of any imminent threat to the life and liberty of the petitioners, it will be open to them to approach any senior police officer of District Kapurthala, for protection. It is expected that in case of any such eventuality, necessary steps will be taken to ensure their protection. (M.M.S. BEDI) December 4, 2015.
