(ORAL) Counsel for the petitioner argues that petitioner was served with a show cause notice dated 25.07.2016 before his retirement pointing out various irregularities/deficiencies on his part while performing duties and also that he has failed to achieve the fixed target as per excise policy for the year 2016-2017.

Counsel for the petitioner argues that petitioner is being harassed as the show cause notice dated 25.07.2016 has not been taken to the final conclusion despite the fact that it is going to be three years since the same was issued, still the respondents have not taken any final decision on the same.

CWP-11344-2019 -2the respondents with a legal notice on 16.11.2018 (Annexure P-3), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.

In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, respondents are directed to decide the legal notice dated 16.11.2018 (Annexure P-3) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
