**** DEEPAK GUPTA, J. (ORAL) On 03.04.2025, the following order was passed:- "

The matter has come up for hearing after 2002. Learned counsel for the appellants submits that although letters have been sent to the appellants, however, no response has been received from the appellants till date. Learned counsel prays that notice to the appellants be issued.

Similar submission is made by learned counsel for respondents No.1 to 4 that she has tried to contact the respondents, however, they are not responding.

In the interest of justice, let actual date of hearing notice be issued to the parties for 10.12.2025. Registry shall also make an effort through the Sarpanch of the concerned village as well as SHO of the concerned area to effect service upon the parties, so that effective steps can be taken to dispose of the matter."

As reported by the Registry, appellants No.1 & 2 and respondents No.1 to 3 are stated to have died. Respondent No.4 has been served but nobody is appearing on his behalf. Respondent No.5 is reported to be not residing at the given address.

Counsel for the appellants has submitted that they are no longer in contact with the appellants and despite strenuous efforts, they are not responding to them.

In these circumstances, it appears that appellants are no longer interested in pursuing the appeal and as such the same is hereby dismissed in default for want of prosecution.
