(ORAL) This Court was pleased to pass the following order on 02.11.2017 :- "This petition under Section 438 of the Code of Criminal Procedure has been filed by the petitioner for grant of anticipatory bail to the him in case FIR No. 93 dated 23.07.2017, under Sections 363 & 366 of the IPC, registered at Police Station Goindwal Sahib, District Tarn Taran. Learned counsel for the petitioners contends that a marriage has been solemnized between the daughter of the complainant Priya and the petitioner on 12.07.2017. In fact, she had appeared before this Court in proceedings in CRM-M28822-2017 and admitted the fact that she had performed a marriage with the petitioner. In the Court, she had stated that she would like to reside with her husband and refused to live with her parents. Learned counsel for the petitioner also submits that the petitioner is ready to join investigation. Notice of motion for 30.01.2018.

CRM-M-41245-2017 -2Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438 (2) Cr.P.C. " Learned counsel for the petitioner submits that the petitioner has joined the investigation.

Learned counsel for the respondent-State, on instructions from HC Jaspal Singh, confirms the factum of joining investigation by the petitioner.

Since the petitioner has joined the investigation, the petition is allowed and interim order dated 02.11.2017 is hereby made absolute subject to the condition that the petitioner will not tamper with evidence or hamper the investigation; will not leave India without permission of the Court and will comply with the conditions contained in Section 438(2) Cr.P.C. 14.05.2018 (JAISHREE THAKUR) Satyawan JUDGE Whether speaking/reasoned Yes.
