The present writ petition has been filed under Articles 226/227 of the Constitution of India praying for issuance of a writ in the nature of certiorari for setting aside the impugned speaking order (Annexure P-4) which is illegal, unlawful and against the principle of natural justice. Further praying for issuance of a writ in the nature of mandamus directing the respondents to refix the pension as the regular employee of the department and not on the basis of the daily wages employees and to their pay/pension may be refixed on the basis of the considering the regular employee accordingly.

At the outset, learned counsel appearing on behalf of the petitioner submits that he has instructions to withdraw the present writ petition and does not wish to press the same any further. 3.
