(Oral)   The present petition has been filed under Section under Section -1439 of Code of Criminal Procedure seeking regular bail in FIR No.33 dated 10.04.2023 under Sections 15(c), 61, 85 (Sections 25, 29 added later on) of NDPS Act registered at Police Station Maur, District Bathinda. 2.

The case of the prosecution is that 240 Kgs of Poppy husk was recovered from one Innova car bearing Registration No.PB-03-BF-9797 which was being driven by co-accused namely, Gurpreet Singh while the other coaccused namely Paramjeet Singh was sitting on the passenger seat of the said car. The car in question was registered in the name of the petitioner. Apart from the ownership of the vehicle, the petitioner is stated to have no role in the alleged offence and was not present at the spot. Moreover, the said vehicle is stated to have been sold to one Gurlal Singh, son of Baldev Singh on 08.09.2021. Thereafter, the said vehicle is stated to have been found in the possession of co-accused namely Gurpreet Singh and Paramjeet Singh. Vide order dated 18.10.2024 passed by the Coordinate Bench of this Court, the petitioner has been granted interim bail .

Learned counsel for the petitioner contends that the trial in the -2present case is yet to commence.

Mr. Amit Rana, Sr. DAG, Punjab, accepts notice on behalf of the respondent-State.

Learned counsel for the State does not refute the fact that trial in the present case is yet to commence.

I have heard learned counsel for the parties and have gone through the material placed on record.

Keeping in view the facts and circumstances of the present case, the order dated 18.10.2024 granting interim bail to the petitioner is made absolute.

It is however, made clear that in case during his bail, the petitioner indulges in any offence, the State shall be at liberty to file an application for cancellation of bail of the petitioner.
