Petitioner has filed this petition under Section 439 Cr.P.C. for grant of interim regular bail in case NCB Crime No.25 dated 08.07.2016 under Sections 8, 15, 18, 29 and 60 of the NDPS Act registered at Narcotics Control Bureau, Zonal Unit, Chandigarh.

Notice of motion was issued and learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the recovery from the present petitioner falls under commercial quantity. A huge quantity of poppy husk has been recovered and about 3-4 kgs. opium was also recovered, which Vineet Gulati 2016.12.08 15:38 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-42147 of 2016 -2also falls under commercial quantity. The petitioner is praying for interim regular bail to attend the marriage of his sister. There is one another brother of the petitioner also.

Keeping in view the facts and circumstances of the present case and the fact that the presence of the petitioner is not essential at the time of marriage of his sister, I do not find any ground to grant interim regular bail to the petitioner.

Therefore, finding no merit in the present petition, the same is dismissed.
