Learned counsel for the petitioner has submitted that no I.A. was withdrawn by the petitioner.

A perusal of the order dated 30.09.2025 shows that the copy of the order passed by the Ist Appellate Court vide which the judgment debtorpetitioner has withdrawn the I.A. was placed on record by the counsel for the decree holder.

On a pointed query raised by this Court, learned counsel for the petitioner has submitted that he has not inspected the record of the Ist Appellate Court and has submitted that the present petition be disposed of and liberty be granted to the petitioner to revive the same after inspecting the record of the Ist Appellate Court in case any cause still survives. 3.

In view of the above, the present petition is disposed of with the aforesaid liberty.
