(ORAL) The petitioner herein seeks the issuance of the direction to respondents No.1 to 3 to conduct fair and impartial investigation in the criminal case registered at Police Station Bhiwani City, District Bhiwani, vide FIR No.483 dated 15.08.2020 under Sections 406, 408 and 420 of IPC and he has further prayed for transferring the investigation of the said case to some independent agency and to call for the status report regarding the investigation conducted by the police authorities till date.

Mr. S.S.Pannu, learned Deputy Advocate General, Haryana, has joined the proceedings on behalf of respondents No.1 to 3 in this case, in pursuance of the copies of this petition having been SEEMA SHARMA 2021.07.06 16:01 I attest to the accuracy and integrity of this document

sent to the respondent-State in advance. He has also forwarded the pairvi report as well as the final report under Section 173 Cr.P.C. to this Court through email, which have been placed on the record. A perusal of the said final report reveals that the cancellation of the subject FIR has been recommended therein.

At this stage, learned counsel for the petitioner submits that in view of the above-said documents, the present petition has become infructuous and he seeks permission to withdraw the same with the liberty to the petitioner to resort to the appropriate and efficacious remedy available to him qua the said cancellation report. Accordingly, the instant petition is hereby dismissed as withdrawn for having been rendered infructuous. The petitioner, however, will be at liberty to avail the appropriate legal remedy, if any, permissible to him in the afore-discussed facts and circumstances.
