I have heard the learned counsel for the parties. The factual matrix, as stated above by the learned counsel for the petitioner, could not be refuted by the learned State counsel on the basis of instructions received by him from the Investigating Officer. The petitioner has been indicted in the present case on the disclosure statement of co-accused. Charges are yet to be framed. Trial of the case would take time to conclude. Therefore, no useful purpose would be served by keeping the petitioner behind the bars.
