******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.124 dated 05.07.2017 registered for offences punishable under Sections 420, 467, 468, 471 and 120-B of Indian Penal Code (for short, "IPC") at Police Station Radaur, District Yamunanagar.

Heard.

Learned State counsel on instructions from ASI Surinder Singh submits that no due certificate, copy of which was supplied by learned counsel for the petitioner, has been got verified. The petitioner has paid the due amount to the bank and parties have also filed a petition (CRM-M33397-2019) seeking quashing of the FIR on the basis of compromise, which is listed for today.

In view of submission of learned State counsel but without expressing any opinion on merits of the case, instant petition is allowed and order dated 09.05.2019, allowing interim bail to petitioner is made absolute, JITENDER KUMAR 2019.11.25 16:15 I attest to the accuracy and integrity of this document Chandigarh

CRM-M-19958 of 2019 -2subject to following terms:- (a) The petitioner shall comply with the conditions mentioned in Section 437(3) Cr.P.C.

(b) In the event of his absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn. The trial Court shall be competent to cancel his bail bond and surety bond and proceed to procure his presence in accordance with law. In that eventuality the petitioner shall have to apply for bail afresh. (c) He shall not leave the country without the previous permission of the Court.
