This criminal miscellaneous petition has been filed by petitioner under Section 482 Cr.P.C. for giving direction to the official respondents to protect the life and liberty of the petitioner and also for giving a direction to them not to cause harassment to the petitioner on the basis of false applications submitted by respondent No.6, qua which the petition filed by respondent No.6, i.e. Criminal Misc. No.M-10064 of 2011, has already been disposed of vide order dated 11.4.2013. I have heard learned counsel for the petitioner and have gone through the record.
Respondent No.6, namely, Ashok Kumar earlier filed petition before this Court for registration of the FIR for cheating him by Sudhir Kumar etc. for `9,73,000/- and this Court vide order dated 11.4.2013 Harpal Singh Parmar 2016.12.05 09:43 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-42196 of 2016 [2] disposed of the petition with liberty to the petitioner to approach Illaqa Magistrate for appropriate relief in accordance with law. In the representation filed by the present petitioner, it has been stated that Ashok Kumar had given an application to the Police alleging against the present petitioner that `9,73,000/- had been paid to the petitioner for appointment of his nephew Aman Kumar in the Punjab School Education Board. There is also allegation in that application that a fake appointment letter was given and money paid was not returned. A perusal of the representation shows that the petitioner only wants that no action should be taken on that application. There is nothing in the representation that any Police official is harassing him or raiding his premises or doing any illegal harassment. It is for the competent authority to look into the application, if any, filed with the Police and this fact itself will not amount to any harassment.
Therefore, finding no merit in this petition, the same is dismissed.
