***** ARUN MONGA, J. (ORAL) Petitioner herein, inter alia, seeks issuance of a writ in the nature of Mandamus for directing respondent No.2 to decide representations dated 02.05.2022 and 10.05.2022 (Annexures P-4 and P-5 respectively), whereby the petitioner has claimed his promotion to the post of Kanungo in SC category being eligible and due to post fallen vacant on account of promotion of earlier Kanungo to the post of Naib Tehsildar.

Succinct facts first. Petitioner was appointed as Patwari on 05.07.2013 in SC category in the office of respondent No.2. There are 10 posts of Kanungo in district Rohtak, out of which two posts are reserved for SC category. He had qualified the examination for the post of Kanungo in the year 2016 and is eligible for promotion to the post of Kanungo in SC category as per seniority list (Annexure P-2) of Patwaris as on 01.03.2020. Despite post fallen vacant due to promotion of Mr. Kailash Chander Kanungo to the post of Naib Tehsildar vide order dated 29.04.2022 (Annexure P-3), the petitioner has not been promoted.
