AT CHANDIGARH Crl. Misc. No. M-4130 of 2015 Date of decision : 19.04.2017 Yogesh Kumar ....Petitioner versus Seema and others

...Respondents

CORAM:

HON'BLE MS. JUSTICE RITU BAHRI

Present:

Mr. Pawn Bansal, Advocate for the petitioner Ms. Chhavi Sharma, Advocate for Mr. P.S. Chauhan, Advocate for the respondents.

**** RITU BAHRI , J. (Oral) The present petition has been filed seeking quashing of order dated 08.01.2015 passed by learned Addl. Sessions Judge, Karnal whereby the learned Judge has affirmed the order dated 26.09.2014 passed by learned JMIC, Karnal whereby in a proceedings under Section 12 of Protection of Women from Domestic Violence Act, petitioner has been directed to pay a sum of Rs.2500/- as interim maintenance and Rs.2000/- on account of rent per month.

Learned counsel for the respondent at the very outset submits that the petitioner has been declared proclaimed offender. Further learned counsel for the petitioner submits that he is not in touch with the petitioner and as per notice issued to the petitioner, the report has been received that the the petitioner has been discharged after treatment in Nasha Mukti Kendar, Samana.

A bare perusal of impugned orders shows that the interim maintenance has rightly been granted to the respondents. Taking the income of the petitioner even as daily wager, the maintenance granted to the respondents, is not on the higher side.

Dismissed.
