Learned counsel for the respondent has pointed out that the present petition deserves to be dismissed at the threshold, inasmuch as there is active concealment of facts. It is submitted that the National Company Law Tribunal, New Delhi, vide order dated 09.03.2026 had dismissed the application under Section 94 of the Insolvency & Bankruptcy Code, 2016 filed by the petitioner. A copy of the said order dated 09.03.2026 has been handed over to the Court, which is taken on record as Mark 'A'. It is submitted that although the present petition was drafted on 30.03.2026 but the same does not make a mention of the said order and rather an argument is sought to be raised on the basis of the right of the petitioner to file an application under Section 94 of the Insolvency & Bankruptcy Code, 2016. 2.

Learned counsel for the petitioner has submitted that he wishes to withdraw the present petition.
