**** RAJ MOHAN SINGH, J.(Oral) As per status report filed by way of affidavit of Sh. Siddhant Jain, IPS, Additional Superintendent of Police, Mahendergarh, District Mahendergarh notice was issued to the complainant by the Investigating Officer during the course of investigation requiring him to give sufficient evidence regarding transactions of money but the complainant did not produce any sufficient material except the photocopy of Diaries (Daily notes) which were taken in police possession vide recovery memo. Thereafter investigation was conducted by SI Virender Singh and during the investigation no sufficient material could come on record to arrest the accused. Ultimately untraced report was MOHMED ATIK 2022.09.08 10:15 I attest to the accuracy and authenticity of this order/judgment

CRWP-5035-2022 prepared by the Police of Police Station Mahendergarh on 01.12.2020 which was sent to the competent officer for its acceptance.

Reply further discloses that if any material is ultimately found in future, the investigation of the case would be conducted on legal parameters. The cancellation report has also been approved by the competent authority on 01.06.2022 and after its approval, the same has been sent to the Court of Illaqa Magistrate, Mahendergarh on 14.06.2022 for its acceptance. Now the case is pending before the Illaqa Magistrate, Mahendergarh for 18.01.2023.

In view of aforesaid status report filed on behalf of respondents No.1 to 3, no further order is required to be passed in the present case, however the complainant would be at liberty to file protest petition before the concerned Court after receiving notice from the Court and pursue the remedy in accordance with law.

Petition stands disposed of.
