***** ARUN MONGA, J. (ORAL) Petitioner herein, inter alia, seeks issuance of a writ in the nature of Mandamus for directing the respondents to consider case of the petitioner qua grant of monetary benefits, as the other departments of the State of Haryana have granted to the employees, who are similarly situated.

Haryana Staff Selection Commission had advertised 414 posts of Gram Sachivs in the Department of Development and Panchayats vide advertisement dated 22.02.1997.Though interviews were conducted but no appointment letters were issued, leading to seek indulgence of this court vide CWP No.16376 of 1999. The said writ petition was allowed in the year 2007, resulting in selection of petitioner alongwith others.

Petitioner's claim is based on the premise that in similar circumstances wherein the vacancies were advertised in the year 2003 for the posts of Art and Crafts Teachers, in the State of Haryana, but appointments were delayed, the selected candidates were given the benefit of ante dated deemed appointment. Qua the aforesaid grievance, petitioner also submitted legal notice dated 03.12.2021 (Annexure P-1) but the same has not been adverted till date.

On advance service, learned State counsel appears and submits that a decision will be taken by competent authority, either way, on the pending legal notice dated 03.12.2021 (Annexure P-1) by passing a speaking order.

At this stage, learned counsel for the petitioner also seeks decision on the pending legal notice, as suggested by learned State counsel.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the instant writ petition is disposed of with a direction to the respondents to look into the legal notice dated 03.12.2021 (Annexure P-1) of the petitioner and pass an administrative order as expeditiously as possible, in accordance with law.
