Present petition has been filed by the petitioner, seeking grant of anticipatory bail, in case, FIR No.42, dated 17.02.2026, under Sections 125, 351(2), 115(2) of BNS (erstwhile sections 336, 506, 323 IPC) and sections 25-27 of Arms Act, registered at Police Station Gate Hakima, District Amritsar.

As per the allegations, petitioner allegedly took out a pistol from his waist and handed it over to an unidentified person, who then fired the pistol in the air outside the house of the complainant, after which they all fled from the spot.

Counsel for the petitioner contends that, even on the basis of the allegations, it was not the petitioner who fired the shot, but an unknown person to whom the pistol was handed over by the petitioner. On being asked by the Court, learned State counsel submits that two empty cartridges and one misfired bullet were recovered from the spot of the incident.

On the other hand, counsel for the petitioner could not explain, whether the petitioner possessed any valid arms licence for retaining the weapon in his possession.

In view of the above, this Court is of the opinion that recovery of the weapon, which allegedly was in the petitioner's possession at the initial stage, is necessary. Therefore, this is not a fit case for granting the concession of anticipatory bail to the petitioner. 7.

During the course of aforementioned recording of the order, learned counsel for the petitioner expresses his inclination to withdraw instant petition.

Dismissed as withdrawn.
