(Oral) Petitioner seeks grant of regular bail under Section 439 Cr.P.C in case bearing FIR No.135 dated 05.05.2014, under Sections 420, 467, 468, 471, 120-B IPC and Section 25 of Arms Act, Police Station Shivaji Colony, Rohtak.
Learned counsel for the petitioner contends that the petitioner is not named in the FIR. His name only appeared on account of disclosure statement of co-accused. Petitioner has no antecedent behavior of any criminal activity in any other case. CRM-M No.41447 of 2014 belonging to his village. Petitioner never made visit nor met Arun Kumar. According to learned counsel for the petitioner, challan stands presented and the trial being magisterial, would take long time to conclude keeping in view the total number of cited witnesses in the challan.
Without expressing any opinion on the merits of the case and keeping in view the period of custody of the petitioner w.e.f. 07.06.2014, petitioner is ordered to be released on bail on his furnishing bail bonds to the satisfaction of the trial Court. However, the petitioner shall not leave the country without prior permission of the Court.
Petition stands disposed of in the above terms. 17.03.2015.
