R.P. Nagrath, J. (Oral) Prayer in the instant petition is made for grant of prearrest bail under Section 438 Cr.P.C. in FIR No. 357 dated 31.10.2013 for offences under Sections 406 and 498-A of Indian Penal Code (IPC), registered at Police Station A Division, Amritsar City, District Amritsar.

In terms of the interim direction dated 26.12.2013, the petitioner jointed the investigation but the subsequent direction for joining again were not complied with.

Learned State counsel on instructions from HC Rampal states that HMA Case No. 5199/1383 of 2014 for divorce by mutual consent under Section 13-B of the Hindu Marriage Act was filed on 15.12.2014, which is now fixed for second motion for 10.07.2015. the complainant has received some amount from the petitioner and rest of the amount is to be paid at the second motion. In view of the above, the interim bail granted vide order dated 26.12.2013 is made absolute.
