Petitioner has filed this petition under Section 438 of the Code of Criminal Procedure, 1973 seeking anticipatory bail in FIR No. 293 dated 9.11.2014 under Section 406, 420, 465, 467, 468, 471, 120-B of the Indian Penal Code, 1860, registered at Police Station Tanda, District Hoshiarpur. While issuing notice of motion, following order was passed by this Court on 04.12.2014:- "Learned counsel for the petitioner has submitted that in fact the complainant himself had sought loan against the fixed deposit receipt of ` 11,00,000/- to the tune of ` 7,50,000/-. In this regard, complainant was issued fifteen pay orders in the sum of GURPREET SINGH 2015.02.19 16:13 I attest to the accuracy and authenticity of this document Chandigarh
Crl. Misc. No. M-41457 of 2014 -2- ` 4,90,500/- each. However, on 16.10.2007, complainant requested that twelve pay orders be got cancelled and four pay orders be issued in favour of AVIVA Life Insurance Company. Petitioner was working as a Manager in the Bank and had acted as per the instructions of the complainant.
Notice of motion for 19.2.2015 In the meantime, in the event of arrest, petitioner be admitted to interim bail subject to the satisfaction of the Arresting Officer. He shall abide by the conditions envisaged under Section 438 (2) of the Code of Criminal Procedure, 1973."
Learned State counsel, who is assisted by Head Constable Kulwinder Singh, has submitted that in terms of the above order, petitioner has joined investigation and is not required for further investigation.
Accordingly, interim bail granted by this Court to the petitioner vide order dated 4.12.2014, is made absolute. Petition stands disposed of accordingly.
