Mr. Dinesh Mahajan, Advocate, for the petitioner. ***** Rajan Gupta, J. (Oral) Petitioner was employed as a Multi Purpose Health Worker (Male) on contract basis with the respondent-department. His name figured in FIR No.16 dated 03.05.2009 under Sections 302, 307, 382, 427, 148, 149 IPC and Sections 25, 27, 54 and 59 of Arms Act. On culmination of trial, petitioner was acquitted. He, thereafter, submitted a representation for being reinstated in service. The authority took a lenient view and petitioner was taken back in service on consolidated salary of Rs.5,000/- p.m. Petitioner has preferred this petition to consider him for regularization on parity with other employees who are working with the respondent-department. I am of the considered view that the prayer is misconceived. It is evident that at the time, petitioner was involved in criminal case, he was working on contractual basis. On his acquittal, the authorities having taken a lenient view, took him back in service on same terms and conditions. Thus, petition is without any merit and is hereby dismissed.
