**** RAMESHWAR SINGH MALIK J. (ORAL) Petitioner seeks pre-arrest bail in FIR No. 242 dated 14.12.2013 under Sections 409/420 IPC registered at Police Station Sadar, Jagraon, District Ludhiana.
Notice of motion was issued and interim protection was granted.
Learned senior counsel for the petitioner refers to the averments taken in para 3 and 4 of the petition, to contend, that petitioner had made it clear while submitting her reply dated 4.12.2013 and that too, on the basis of documentary evidence, that AMIT KUMAR 2015.05.19 10:08 I attest to the accuracy and authenticity of this document
Criminal Misc. No. M-44199 of 2013 amount alleged to have been embezzled viz-a-viz 16 out of 18 accounts have since already been deposited with the department, therefore, refund was made to the consumers. He further submits that in compliance of the order passed by this court, petitioner has joined the investigation and she is not required for the purpose of any further investigation.
When confronted with the abovesaid statement made by learned senior counsel for the petitioner, learned counsel for the State as well as learned counsel for the respondent could not contest this factual statement made on behalf of the petitioner. In view of the above, order dated 27.12.2013 passed by this Court is hereby made absolute, however, subject to the conditions envisaged under Section 438 (2) Cr.P.C. Disposed of, accordingly.
