Appellant had filed suit for declaration that he was entitled for the post of Molasses Clerk in the pay scale of `10501600/- w.e.f. March 1991, the date of his initial appointment. The suit filed by the appellant was dismissed by the trial Court vide judgment/decree dated 10.06.2002. The said judgment and decree were upheld by the First Appellate Court vide judgment/decree dated 29.01.2004 in an appeal filed by the appellant. Hence, the present appeal by the appellant-plaintiff.

Learned counsel for the appellant has submitted that he may be permitted to withdraw this appeal as the pay scale claimed by the appellant by way of the suit in question has been granted to the appellant.

Dismissed as withdrawn.
