Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 seeking regular bail in FIR No. 99 dated 8.9.2012 under Section 457, 380 of the Indian Penal Code, 1860, registered at Police Station Sadar Kapurthala, District Kapurthala.

Heard.

Although, petitioner had absented during trial but now he is in custody since 22.7.2015. Co-accused of the petitioner who had faced trial, has since been acquitted by the Trial Court vide order dated 13.10.2014 (Annexure P-2).

Accordingly, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner be admitted to bail subject to the satisfaction of Chief Judicial Magistrate, Kapurthala.
