(ORAL) The petitioner herein seeks a direction to respondent No.2 to further direct respondents No.3 to 6 to submit a status-report in the criminal case pertaining to the FIR bearing No.4 dated 04.01.2021 registered at Police Station Ladwa, under Section 306 IPC and to direct the official respondents to consider and act upon the representation dated 03.06.2021 (Annexure P-3) and also to transfer the investigation of the said case to Crime Branch or any other competent authority of some other District except Districts Yamuna Nagar and Karnal. Reply by way of the affidavit of Deputy Superintendent of Police, Ladwa, Kurukshetra as well as the Post Mortem Examination Report (Annexure R-1) and Crime Scene Visit Report (Annexure R-2) NEETU RANI 2021.08.31 18:33 I attest to the accuracy and integrity of this document PHHC

Learned State counsel submits that the subject FIR has already been cancelled by the police authorities and this fact also finds mention in para No.5 (reply on merit) in the said written reply and he further submits that the cancellation report shall be presented before the competent Court shortly.

At this stage, learned counsel for the petitioner seeks permission to withdraw the instant petition while submitting that in the light of the above-discussed facts and circumstances, the petitioner would be availing the alternative efficacious and appropriate remedy, as may be permissible to him under law, to seek the redressal of his grievance, as set-forth in this petition.

Learned State counsel has no objection for the same. Resultantly, the petition in hand stands dismissed for having been withdrawn accordingly.
