Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.101 dated 29.08.2013 under Section 22 of NDPS Act registered at Police Station Sadar Phagwara, District Kapurthala.

Notice of motion was issued and learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per the prosecution version, 100 grams of intoxicant powder has been recovered from the present petitioner. As per FSL report, copy of which has been placed on record today by learned VINEET GULATI 2015.01.16 10:48 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-41509 of 2014 -2State counsel, Methamphetamine salt has been found in the sample. More than 50 grams of this salt falls under commercial quantity. Keeping in view the provisions of Section 37 of the NDPS Act where there is bar to grant bail to the accused in case of commercial quantity, I do not find any merit in the present petition and therefore, the same is dismissed.
