In the instant petition, prayer is made for grant of anticipatory bail in case FIR No. 50 dated 3.4.2024, under Section 21-B of the NDPS Act, 1985, registered at Police Station Canal Colony, Bathinda.

Earlier a Coordinate Bench of this Court granted interim relief to the petitioner. Today, learned State counsel, on instructions imparted to him by ASI Manjeet Singh, informed this Court that in fact, the petitioner is involved in two other cases, therefore, he is a habitual offender.

CRM-M-21512-2024 difficulty, submits that he may be allowed to withdraw the present petition. However, he made a request to pass directions to the learned trial court concerned to decide his regular bail, if he surrenders, and files such bail application.

The request is accepted. The instant petition is dismissed as withdrawn.

In case the petitioner surrenders before the learned trial court concerned within 10 days from today, and files his regular bail application, the latter shall make all endeavour to decide the same within two days.
