RAJESH BHARDWAJ, J.(ORAL) Petitioner has approached this Court praying for issuance of directions to respondents No.1 to 6 to take appropriate legal action against respondents No.7 to 13 as well as to remove the illegal possession of respondents No.7 to 13 from the panchayat land as well as common way (Aam Rasta) at Gram Panchayat Khori Shah Chokha in the interest of justice. It is further prayed to decide the representation of the petitioner, Annexure P-3, expeditiously. It is also prayed to protect the life and liberty of the petitioner and her family members from the hands of respondents No.7 to 13.
Learned counsel for the petitioner has reiterated his submission as made in the petition and prayed for taking legal action against respondents No.7 to 13, who are in illegal possession of Panchayat land. CWP-10296-2024 -2On asking of the Court, Mr.Sumit Gupta, Additional Advocate General, Haryana, who is present in Court, accepts notice on behalf of the respondents/State. In pursuance of the directions issued by this Court on 06.05.2024, Mr.Surjit Singh, BDPO is present in Court. He has apprised the Court that there is an illegal possession of the respondents, as submitted in the petition. However, he submits that he has already initiated the action for removal of this encroachment and the police help is also sought for taking the necessary action on 30.05.2024. He has submitted that encroachment, as prayed, would be removed on 30.05.2024, the date already fixed. In view of the submissions made by the Officer present in Court, the present petition is disposed of with a direction to him to comply with the statement given by him before this Court in accordance with law. However, the petitioner would be at liberty to avail his remedy in case any further cause of action accrues to him.
