Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.15 dated 16.01.2015 under Sections 386, 506, 120-B IPC and Section 25 of the Arms Act, registered at Police Station Safidon, District Jind.

Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per the last order dated 13.01.2017, the Investigating Officer was directed to produce the complainant and eye witnesses before the trial Court for their examination. CRM No.M-42347 of 2016 -2notice of this Court that complainant and one of the eye witnesses has already been examined but they have not supported the prosecution case qua the present petitioner.

The petitioner is in custody since 30.01.2015. He is not required for custodial interrogation or investigation as he is in judicial custody. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the disposal of the case. Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds in the sum of `50,000/- with two sureties in the like amount to the satisfaction of the trial Court/Duty Magistrate.
