Petitioner has filed this petition under Section 482 Cr.P.C. for quashing of FIR No. 89 dated 06.09.2013 registered under Sections 457, 380, 511 IPC at Police Station City Budhlada, district Mansa and the subsequent proceedings arising therefrom. State has filed reply by way of affidavit of Rajveer Singh, Deputy Superintendent of Police, Sub Division: Budhlada, district Mansa. According to said affidavit, FIR in question was lodged under sections 457, 380, 511 IPC on the basis of complaint moved by respondent no. 2. He stated that he has a dairy shop at Budhlada Kulana Road, near Kulana Chowk. He used to come to the shop at around 7.00 a.m. and left at 10.00 p.m. On 06.09.2013, at about 1.00 a.m., he received a phone call from one Gurpreet Singh that petitioner was trying to break open the shutter of his shop. Certain other persons witnessed this incident. CRM M-4143 of 2015 etc. These were recovered by the police. Investigation ensued and challan was presented before the competent court on 03.10.2013. Trial is already in progress.
In view of nature of crime committed, I am of the considered view that no case for quashing on the basis of compromise is made out. Dismissed.
