LISA GILL, J. (Oral) Prayer in this petition is for cancellation of anticipatory bail granted to respondent No.2 in FIR No. 10 dated 01.02.2015 under Sections 406, 498-A, 323 IPC registered at Police Station Women Cell, District Ludhiana.
It is submitted that this Court vide order dated 10.11.2016 in CRM-M-10024 of 2016 filed by parents-in-law of the petitioner seeking anticipatory bail had directed that the petitioner along with her children shall be permitted to stay in one room at first floor of the house where children of her brother-in-law (Jeth) were residing. Learned counsel for the petitioner fairly submits that during the pendency of this petition the petitioner along with her children have been Rupinder Kaur 2018.01.18 12:55 I attest to the accuracy and integrity of this document
Crl. Misc. No. M-42377 of 2016 [ 2 ] permitted to reside in the said room. It is submitted that at this stage she does not seek to pursue the present petition however her peaceful possession of the said room may not be disturbed. Learned counsel for respondent No.2 undertakes that possession of the petitioner over the said one room on the first floor of the house shall not be disturbed and he shall pay the arrears of maintenance as awarded by this Court within eight weeks.
