The case has been taken up for hearing through video conferencing on account of Covid-19 pandemic. Petitioner has approached this Court for issuance of a writ in the nature of mandamus directing respondent No.2 to pass an appropriate order in the light of clarification dated 21.11.2019 (Annexure P-9) issued by respondent No.1 and place the petitioner at serial number 3 in the seniority list of Secretaries as per the 100 points roaster. He has further sought issuance of a writ of mandamus directing respondent No.2 to rectify the seniority of the petitioner as Field Worker and to consider his case for promotion to the next higher post of Inspecting Officer. Still further, he has sought the direction to respondent No.3 to grant him the benefit of ACP Scheme upon completion of 04 years service, apart from other annual increments, which have not been given to him since the year 2013 alongwith interest.

CWP No.10756 of 2020 {2} category of Punjab. He is working on the post of Field Officer with the Punjab State Federation of Co-operative House Building Societies Limitedrespondent No.2. His name was enrolled in the seniority list of Secretary Cadre w.e.f. 31.05.1991 but he was not given the benefit of seniority on the basis of various instructions issued by the Government from time to time. He has also been denied the consequential benefits including ACP. He has submitted a comprehensive representation dated 31.05.2019 (Annexure P-7) to respondent No.2 but the same remains un-attended. Counsel for the petitioner submits that at this stage, the petitioner will be satisfied in case a direction is issued to respondent No.2 to decide his representation. Notice of motion.

On the asking of the Court, Mr.Vikas Mohan Gupta, Additional Advocate General, Punjab who is available on conference call, accepts notice on behalf of the respondents. He does not oppose the prayer made by counsel for the petitioner.

Without examining the averments made in the writ petition or the claim raised by the petitioner and his representation, this petition is disposed of with a direction to respondent No.2 to pass a speaking order in the representation dated 31.05.2019 (Annexure P-7) submitted by the petitioner within a period of four months from the date of receipt of a certified copy of this order.
