Swarna v. Jaswinder Singh And ORS
CRM-M-42436-2016 -1-
IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH
CRM-M-42436-2016 Date of Decision: 14.02.2020 Swarna .... Petitioner
Versus
Jaswinder Singh and others .... Respondents CORAM: HON'BLE MR. JUSTICE RAMENDRA JAIN Present: - Mr. Ajay Kumar, Advocate for Mr. Rishu Mahajan, Advocate for the petitioner. RAMENDRA JAIN, J. (ORAL) Through this petition under Section 482 Cr.P.C, petitioner has prayed for quashing impugned order dated 17.10.2015 (Annexure P-1) of the trial Court, dismissing his complaint bearing No. 26476/2013 dated 31.05.2012 and order dated 23.08.2016 (Annexure P-2) of the revisional Court, whereby his revision against the order of trial Court, was also dismissed.
Proxy counsel for the petitioner prays for adjournment on the ground that arguing counsel is in some personal difficulty. No justification.
Perusal of file shows that after filing of this petition in the year 2016, the same has been taken on Board for 8 times, out of which on 5 occasions, none came forward to represent the petitioner. On 3 occasions, adjournments were sought.

CRM-M-42436-2016 -2The above fact creates a doubt in the mind of this Court, as to why, petitioner is continuing with the instant petition for the last more than 31⁄2 years, for no reason. Even otherwise, perusal of impugned orders of both the Courts below recording concurrent findings show that they are well reasoned and self-speaking. There is no infirmity or illegality in the same. Thus, inherent power of this Court under Section 482 Cr.P.C., which has to be used sparingly with due care and caution is not required to be exercised in the instant case. Dismissed.
