The instant petition has been filed by the petitioner seeking a writ of mandamus for directing respondent No.2, to decide the statutory appeal dated 10.04.2024 (Annexure P-15) filed by petitioner, against the show cause notice dated 21.09.2023 (Annexure P-1) and recovery order dated 18.03.2024 (Annexure P-2), in a time bound manner. Further prayer has been made to direct respondent No.1, not to effect recovery from the salary of the petitioner in pursuance to the order dated 18.03.2024.

Learned counsel for the petitioner prays for deciding the appeal filed by the petitioner dated 10.04.2024 (Annexure P-15) expeditiously by passing a speaking order in a time-bound manner 3.

Mr. Navdeep Chhabra, Advocate, accepts notice on behalf of the respondents and submits that the appeal filed by the petitioner shall be decided expeditiously.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction that the appeal dated 10.04.2024 (Annexure P-15) pending before the Appellate Authority shall be decided within a period of 03 months from the date of receipt of certified copy of this order. Further recovery from the petitioner shall remain stayed and would be subject to the final order that may be passed by the Appellate Authority.

The petition stands disposed of.
