The instant petition has been filed by the petitioner seeking a writ of mandamus for directing respondent No.2, to decide the statutory appeal dated 24.04.2024 (Annexure P-2) filed by petitioner, against the order of recovery dated 10.04.2024 (Annexure P-1). Further prayer has been made to direct respondent No.1, not to effect recovery from the salary of the petitioner in pursuance to the order dated 10.04.2024.

Learned counsel for the petitioner prays for deciding the appeal filed by the petitioner dated 24.04.2024 (Annexure P-2) expeditiously by passing a speaking order in a time-bound manner 3.

Mr. R.S. Kalra, Advocate, accepts notice on behalf of the respondents and submits that the appeal filed by the petitioner shall be decided expeditiously.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction that the appeal dated 24.04.2024 (Annexure P-2) pending before the Appellate Authority shall be decided within a period of 03 months from the date of receipt of certified copy of this order. Further recovery from the petitioner shall remain stayed and would be subject to the final order that may be passed by the Appellate Authority.

The petition stands disposed of.
