Through the instant petition, the petitioners seek protection of their lives and also liberty to profess the business of hotels, being run on rent, from the illegal act and conduct of the official respondents, who are harassing them unnecessarily at the behest of respondent No.5. 2.

The short reply dated 21.05.2024, as became filed to the instant petition, makes revelation that there is no apprehension to the lives and liberty of the petitioners. The relevant paragraphs of this short reply are reproduced hereinafter:- "7. That after that on 15.05.2024 said Deepak Kumar got recorded his statement with the police that he is working at Raja Dhaba, where Sanjeev Kumar is serving as Manager. On 27.04.2024 he alongwith Sanjeev Kumar and Pawan Kumar were present at the hotel then some boys came to their hotel and ordered tea for them and when manager demanded bill @ Rs.20/- per cup from said boys, then all of them started arguing and they DEVINDER YADAV 2024.05.30 09:06 I attest to the accuracy and authenticity of this order/judgment

CRWP-3971-2024 have also caused injuries on person of Sanjeev Kumar, Pawan Kumar and Sonu and all of them run away from the spot by throwing brick bites towards hotel. As per MLR of Deepak Kumar, there were total 7 blunt injuries on his person out of which injuries no.4 to 7 were kept under observation, whereas remaining injuries were declared simple. As per MLR of Pawan Kumar there were two simple (Blunt) injuries on his person and as per MLR of Sonu there were three blunt injuries were on his person and all three injuries were kept under observation by the Doctor. As per statement of Deepak Kumar only offence u/s 323/427/149 IPC was made out which were non compoundable in nature, so DDR No.36 dated 15.05.2024 has been entered in the General Diary. Copy of DDR is attached herewith as Annexure R2/T.

8. That during enquiry it was also found that there is no apprehension to the life and liberty of the petitioners. Moreover, no such occurrence as alleged by the petitioner was taken place on 12.01.2024. It is also found that respondent no.5 is owner of Raja Hotel and Restaurant and petitioners have taken the same on rent. Now respondent no.5 wants to get vacated his premises and with malafide intention to pressurize the respondent no.5, the petitioners have filed the instant petition before this Hon'ble Court."

In view of the revelations (supra), since there is no threat to the lives and liberty of the petitioners, therefore, no further direction is required to be made in the instant petition. Consequently, the instant petition is closed.
