By way of present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, the petitioner has approached this Court for quashing/setting aside the order dated 24.05.2022, whereby his bail bonds/surety bonds were cancelled and warrants of arrest were issued against him and also the order dated 17.01.2025, whereby proclamation against the petitioner was ordered to be issued and his surety namely Sukhwinder Singh was ordered to be summoned through bailable warrants.
Vide order dated 06.05.2025, the petitioner was directed to appear/surrender before the learned Trial Court. After his appearance, the Trial Court was directed to release him on interim bail on his furnishing personal/surety bonds, to the satisfaction of the concerned Court. The petitioner was also directed to furnish a specific undertaking with regard to MONIKA 2025.07.04 17:48 I attest to the accuracy and integrity of this document

The order dated 19.05.2025, passed by learned Additional Sessions Judge, Sangrur, has been placed on record. A perusal of this order reveals that in terms of the order dated 06.05.2025, the petitioner has surrendered before the Trial Court on 19.05.2025 and has been granted interim bail in terms of order passed by this Court. Learned State counsel has also admitted that the petitioner has surrendered before the learned Trial Court and has been admitted to interim bail. Status Report by way of affidavit of Rupinder Kaur, PPS, Deputy Superintendent of Police, Sub Division Dirba, has also been filed on behalf of respondent-State, which is ordered to be taken on record. The Status Report also corroborates the aforesaid factual position. In view of the aforesaid facts and circumstances, the orders dated 24.05.2022 and 17.01.2025, whereby bail bonds/surety bonds of the petitioner were cancelled, thereby issuing warrants of arrest and proclamation against him, stand quashed.
However, nothing observed herein above shall be construed to be an expression of opinion on the merits of the case. The observations recorded herein above are only for the purpose of deciding the present petition.
