JASWANT SINGH, J (ORAL) Prayer made by the two accused is for grant of regular bail in case FIR No.74 dated 31.10.2015 under Section 61 of the Punjab Excise Act, 1914.

As per the allegations, there is a recovery of 300 boxes of country-made liquor from a Bolero Pick up being driven by petitioner No.2-Jagdish Singh and accompanied by petitioner No.1-Ranjit Singh.

It is contended that the petitioners are in custody since 31.10.2015 and investigation qua them is over. It is further submitted that the petitioners have been falsely implicated and there are no other cases pending against them. Learned state counsel, on instructions from ASI Balwant Singh, concedes that the investigation qua the petitioners is over. Without commenting upon the merits of the case and taking into account the facts of the present case and that the trial is not going to be concluded in the near future, no useful purpose

CRM-M- 41573 of 2015 #2# would be served by putting the present petitioners further in custody.

In view of the above, present petition is allowed and the petitioners are ordered to be released on bail to the satisfaction of CJM/Duty Magistrate/Duty Magistrate, Mansa.
