The petitioners in connivance with other co-accused had duped the complainant Bank of a sum of Rs. 28 lacs by obtaining loan on the basis of fake pay slips and identity cards. Counsel for the petitioners submits that the petitioners had lodged a complaint that by using genuine employment certificates, the employees of the bank had granted loan to the fictitious persons. Without expression of any opinion on merits of the case, it is sufficient to observe that pursuant to the interim order passed by this court, the petitioners have discharged partly their liability and have undertaken to discharge their remaining liability during the further course of time as per the terms of return of money.

In view of the above, it is not a case of custodial interrogation. Accordingly, the petition is allowed it is ordered that in case of arrest of the petitioners, they will be released on bail to the satisfaction of the arresting officer subject to the condition that they will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
