(Oral) This is a petition filed under Section 438 of the Code of Criminal Procedure seeking pre-arrest bail in a case registered against the petitioner vide FIR No.61 dated 20.07.2017 under Sections 452, 323 and 34 IPC (Section 325 IPC added later on) at Police Station Dera Baba Nanak, District Batala.
Learned counsel for the State submits that pursuant to order dated November 06, 2017, petitioner has joined investigation and is no longer required for custodial interrogation.
In view of the above, order dated November 06, 2017, is hereby made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C. The amount of Rs.25,000/- deposited with the registry be remitted to the complainant in view of order dated November 21, 2017 passed by the co-ordinate Bench.
Disposed of.
