(ORAL) Learned State counsel contends that instant petition has rendered infructuous in view of the fact that all the prosecution witnesses have already been examined and the trial is now fixed for 28.11.2018 for recording statement under Section 313 Cr.P.C. Perusal of file shows that on the last date of hearing i.e. 13.08.2018, the petitioner had gone un-represented. Today also, none has appeared on his behalf. Therefore, it can safely be presumed that petitioner or his counsel is no more interested in pursuing the present petition.
