Instant writ petition has been filed under Article 226/227 of the Constitution of India inter alia for issuance of a writ in the nature of mandamus directing the respondents to decide the representation dated 12.04.2024, Annexure P-3, submitted by the petitioner to the official respondents.

Counsel for the petitioner submits that petitioner was granted a licence under the Haryana Targeted Public Distribution System (Licensing & Control) Order, 2022, for purchase, sale and storage of essential commodities, which was extended from time to time upto 31.03.2024. He submits that before its expiry, petitioner deposited the requisite fee with the authorities on 23.02.2024, Annexure P-2, however, licence was not extended despite the fact that petitioner has submitted a representation, Annexure P-3. Counsel submits that he has received a communication bearing Memo No.FG-1-2023/6477 dated, 29.04.2024, relevant extract of which is reproduced as under:- PARDEEP NAUTIYAL 2024.05.03 16:32 I attest to the accuracy and authenticity of this order/judgment.

It is to inform you that various writ petitions have been filed in the Hon'ble Punjab & Haryana High Court, Chandigarh for quashing the proviso added to clause-6 of the Haryana Public Distribution System (Licensing & Control) Order, 2022 which restricts the renewal of Fair Price Shop Licensing beyond the age of 60 years Interim relief granted by Hon'ble Court on 28.02.2023 was extended on 18.03.2024 and the next date of hearing is 17.07.2024. All the DFSCs have been directed to renew the FPS licenses of all concerned depot holders till 31.07.2024 who have attained the age of 60 years. It is for your kind information please.
