Mr.Lalit Gupta, Advocate, for the complainant. M.M.S. BEDI, J (ORAL) Co-accused of the petitioner namely Mandeep Singh and Pritam Singh who had allegedly cheated Sukhpal Kaur of a sum of Rs.8.80 lacs by getting the amount deposited in the bank account in the name of Suresh Pal in the Punjab National Bank, have been granted the concession of regular bail. Suresh Pal has also been released on bail.

So far as the petitioner is concerned, he is alleged to have duped the complainant for a sum of Rs.2 lacs. Pursuant to interim orders passed by this Court, the petitioner has deposited a bank draft of Rs.1 lac in the name of Sukhpal Kaur which amount has been released to the complainant as admitted by the counsel for the

CRM-M-41762-2014 (O&M) complainant appearing in the Court today.

Without expression of any opinion on merits of the case, taking into consideration the fact that the co-accused of the petitioner has been granted bail and the petitioner to some extent has also discharged his liability, he can be granted the concession of regular bail.

The petition is allowed. The petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction fo the trial Court without prejudice to the rights of the complainant to avail the civil remedies available to him. The amount deposited is subject to any final conclusion regarding the liability of the parties determined at any forum.
