Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.75 dated 29.04.2016 under Section 15 of the NDPS Act, registered at Police Station Guhla, District Kaithal. Notice of motion.
On asking of the Court, Mr.Vikramjit Singh, Addl. Advocate General, Haryana, who is present in the Court, accepted notice on behalf of the respondent-State and contested the petition. Police record is also available.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that, 159 kgs. of poppy husk has been recovered from the present petitioner and co-accused, which falls under Vineet Gulati 2016.12.08 15:38 I attest to the accuracy and authenticity of this document Chandigarh commercial quantity. As per Section 37 of the NDPS Act, bail cannot be
CRM No.M-42603 of 2016 -2granted in the case of commercial quantity. Therefore, finding no merit in the present petition, the same is dismissed.
