Case has been taken up through video-conferencing in view of the outbreak of Pandemic COVID-19.

By way of the present petition, the petitioner above-named has sought the indulgence of this Court for seeking relief of bail in the case registered vide FIR No.84 on 23.06.2020 at Police Station Amloh, District Fatehgarh Sahib, under Section 61 of the Punjab Excise Act, 1984. Learned State Counsel has put in appearance in pursuance of the advance notice issued to the respondent State. Learned counsel for the petitioner contends that the co-accused of the petitioner namely Sewa Ram @ Mewa and Krishan Kumar have already been granted bail in this case by the Sessions Court vide orders annexed herewith as P-2 and P-3 respectively and therefore, the petitioner is also entitled to the relief of bail on the ground of parity. She also contends that the recovery has already been effected in the present case and no useful purpose will be served by detaining the petitioner in the jail. Learned State Counsel does not dispute the afore-discussed facts.

Keeping in view the afore-discussed facts and circumstances and also the facts that the petitioner is behind the bars since 23.06.2020 and the trial of this case is likely to take sufficient time to conclude on account of the restrictive functioning of the Courts in the wake of the outbreak of Pandemic COVID-19 and without expressing any opinion on the merits of this case, it is hereby ordered that the petitioner be released on regular bail, subject to his furnishing the requisite bail bonds/surety bonds, to the satisfaction of concerned trial Court/Chief Judicial Magistrate/Duty Magistrate.

The petition stands allowed accordingly.
