Petitioners have filed this petition under Section 482 of the Code of Criminal Procedure, 1973 for quashing of FIR No.206 dated 22.10.2014, under Sections 363 and 366-A of the Indian Penal Code, 1860 ('IPC' for short) registered at Police Station C-Division, Amritsar City, District Amritsar and all consequential proceedings arising therefrom. Learned counsel for the petitioners has submitted that petitioner no.1 and his wife Roji had filed CRM-M-390502014 seeking protection of their life and liberty and the said petition was disposed of by this Court vide order dated 17.11.2014. However, respondent No.2 father of Roji had lodged the FIR against the petitioners alleging that his

CRM-M-41804-2014 [ 2 ] ***** daughter had been kidnapped/abducted by petitioner No.1. In fact, petitioner No.1 and Roji daughter of respondent No.2 are residing together as husband and wife.

Respondent No.2 has also stated that he has no objection qua the marriage performed by his daughter with petitioner No.1 and does not want to proceed further with the criminal case got registered by him against the petitioners. Respondent No.2 also tender his affidavit in this regard. In the present case, daughter of respondent No.2 has performed marriage with petitioner No.1 and is presently residing with petitioner No.1 in the matrimonial home. Continuation of criminal proceedings against the petitioners would not serve any useful purpose. Rather continuation of criminal proceedings against the petitioners would adversely affect the matrimonial life of the daughter of the complainant. Accordingly, this petition is allowed. FIR No.206 dated 22.10.2014, under Sections 363 and 366-A of the Indian Penal Code, 1860 registered at Police Station C-Division, Amritsar City, District Amritsar and all the consequential proceedings, arising therefrom, are quashed.
