The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.98 dated 10.4.2019 registered at Police Station Mahesh Nagar, District Ambala under Sections 406 and 420 of Indian Penal Code.

The FIR in question was lodged at the instance of Baldev Singh, wherein it has been alleged that he had paid an amount of `5.13 lakhs to the petitioner Tarsem Lal for the purpose of sending his son Vishavjeet Singh abroad. It has been alleged that out of the aforesaid amount while `1 lakh had been paid in cash, the remaining amount of `4.13 lakhs had been transferred to the bank account of aforesaid Tarsem Lal.

At the time of issuance of notice of motion, it had been submitted on behalf of the petitioner that in case any amount is due to be paid, he shall return the PANKAJ KAKKAR 2020.01.13 17:31 I attest to the accuracy and integrity of this document

( 2 ) CRM-M-19979-2019 (O&M) same to the complainant. Consequently, the petitioner was granted interim bail and was directed to join investigation.

However, despite several adjournments, it appears that no amount has been paid to the complainant.

The learned State counsel has today informed that infact despite specific directions, the petitioner has not even joined investigation. 6.

In view of the aforestated conduct of petitioner, this Court does not find any special case for grant of anticipatory bail. The petition is sans merit and is hereby dismissed.
